Desde los colectivos Papeles y Derechos Denontzat, Médicos del Mundo Navarra y SOS Racismo Navarra,llevamos más de 3 años denunciando la existencia de actuaciones de diversas Policías presentes en Navarra que derivan en citaciones ante la Brigada de Extranjería de Navarra (comisaría de Policía Nacional en Pamplona), cuando acuden a estas citas hemos constatado varias actuaciones que se dan de manera aleatoria y que van desde la retirada del pasaporte, entrega de comunicaciones de salida obligatoria (vía sello en su pasaporte original o entrega de comunicación), incoación expediente de expulsión, hasta citaciones periódicas ante la Brigada de Extranjería. Estas citas tienen su origen en contextos diversos: controles de movilidad (incrementados durante las fases del estado de alarma), controles de identidad por perfil étnico, etc. o durante el transcurso de una intervención policial, llegando a constatarse citaciones cuando la persona acudía a interponer una denuncia como víctima de un posible delito. 

Entendemos que estas actuaciones pueden tener su origen en un cambio de criterio basado en que las detenciones llevadas a cabo por la Brigada de Extranjería de la Policía Nacional por el mero hecho de identificar en la calle a personas extranjeras en situación irregular, es una práctica declarada nula por diversas Sentencias, lo que ha podido llevar a sustituir la detención por citación en dependencias policiales. Queremos destacar la especial gravedad que supone la colaboración de los cuerpos policiales locales y forales en este tipo de citaciones, lo que nos lleva a pensar en la existencia de una Instrucción específica emitida por la Dirección General de Policía, que se está ejecutando y de la que no tenemos información ni conocimiento. 

Desde nuestros colectivos hemos elaborado un protocolo de actuación para denunciar estos casos, por las graves consecuencias que tienen, sobre todo, para las personas extranjeras en situación administrativa irregular y porque entendemos que se trata de prácticas que además de ilegítimas y vulneradoras de derechos, son irregulares. Por ello, cada vez que detectamos algún caso de citación,actuamos remitiéndolo al Defensor del Pueblo de Navarra, que a su vez lo remite al estatal, dando traslado de estos al Departamento de Políticas Migratorias y Justicia. 

Los modelos de citaciones que son entregados contienen “advertencias” de que “se podrá proceder” o directamente que “se procederá” a la detención de quienes decidan no comparecer. En algún caso, se realiza sin hacer ninguna referencia a la normativa que posibilita esa detención y, en otros, se alude a normativa de extranjería de la siguiente manera:

Se le advierte de que, en caso de incumplir este requerimiento, en virtud de lo dispuesto en el artículo 61.d) de la LO 4/2000, 234 Y 242 del RD 557/2011, se podrá proceder a su detención y posterior traslado a estas dependencias.

¿Por qué esas detenciones no tienen amparo legal?

El artículo 17 de la Constitución establece dos cuestiones esenciales: por un lado, que TODA PERSONA tiene derecho a la libertad y a la seguridad. Y, por otro lado, que NADIE puede ser privado de su libertad, sino con la observancia de lo establecido en este artículo y en los casos y en la forma previstos en la ley.

Este artículo dice expresamente toda persona y, por tanto, se está refiriendo a todas y cada una de las que nos encontramos bajo la jurisdicción del Estado español, con independencia de nuestra nacionalidad o nuestra situación administrativa.

La libertad es un derecho fundamental inherente a la dignidad humana, que nos pertenece a todos y todas por nuestra condición de personas y que, por tanto, debe ser respetado y garantizado igualmente a nacionales y migrantes, en situación regular o irregular.

El derecho a la libertad nos pertenece a todos y todas y NADIE puede ser privado de su libertad, sino con la observancia de lo establecido en el artículo 17 de la Constitución y en los casos y en la forma previstos en la ley.

Lo que significa que: ninguna persona, nacional ni tampoco extranjera, ya se encuentre en situación regular o irregular, puede ser detenida de manera arbitraria. Ningún poder público, ninguna administración, ninguna autoridad, ningún funcionario o funcionaria pública, está legitimada para establecer o llevar a cabo privaciones de libertad a su antojo. Las detenciones, como medidas privativas de la libertad, únicamente pueden producirse en los casos y en la forma que prevea la Ley. 

Y, los que nos hemos encontrado, los casos que estamos denunciando, no están previstos en la ley. 

La normativa de extranjería no ampara ninguna detención que pueda producirse al margen de un procedimiento sancionador. Es cierto que el artículo 61.d) de la ley de extranjería prevé, como medida cautelar, la detención de personas extranjeras con el fin de asegurar su expulsión si se encuentran en situación irregular, pero el artículo es muy claro al respecto: la adopción de esta medida cautelar solo es posible desde el momento que se incoe un procedimiento sancionador; nunca antes.

En la actualidad, la normativa de Extranjería contempla la estancia o residencia irregular como infracción administrativa y habilita a la administración para ejercer su potestad sancionadora, pero esta debe llevarse a cabo mediante un proceso regulado. El ejercicio de la potestad sancionadora requiere indefectiblemente de la existencia de un procedimiento sancionador donde se garanticen los derechos de las personas administradas. Y, toda actuación que se produzca al margen de ese procedimiento no tiene amparo legal.

En definitiva, ningún poder público, ninguna administración, ninguna autoridad, ningún funcionario o funcionaria pública puede ordenar o practicar una detención de una persona en situación irregular sin que previamente se haya iniciado un procedimiento administrativo sancionador.

Sin embargo, las citaciones que se entregan contienen la siguiente advertencia explícita: si no cumplen con el requerimiento de acudir en el día y la hora indicada a las dependencias de la Policía Provincial de Extranjería y Fronteras, serán o podrán ser detenidas.

Se amenaza a personas en situación irregular con posibles detenciones sin que estas, en este momento, tengan ningún amparo legal.

Las entidades Papeles y Derechos Denontzat, Médicos del Mundo Navarra y SOS Racismo Navarra entendemos que esta actuación va en contra del derecho a una buena administración, recogido en el artículo 41 de la Carta de los Derechos Fundamentales de la Unión Europea. En virtud de este derecho, que corresponde a todas las personas, la administración y el personal a su servicio, debe actuar de conformidad con la legislación, sin arbitrariedad, abuso de poder o discriminación, con independencia e imparcialidad, con objetividad y con proporcionalidad en la adopción de sus decisiones, respetando los derechos y las expectativas de la ciudadanía. Una buena administración implica un ejercicio del poder legítimo, transparente y respetuoso con los derechos humanos, regido por criterios éticos y deontológicos; no basada en amenazas con restricciones de derechos fundamentales que carecen de amparo legal.

Por otro lado, queremos resaltar que esta actuación tiene consecuencias especialmente graves para las víctimas de delitos que se encuentran en situación administrativa irregular porque las coloca en una situación de absoluta desprotección al generar rechazo a acudir a dependencias policiales para denunciar cualquier delito que sufran por temor a que se les incoen procedimientos de expulsión. Hecho que resulta especialmente grave en casos de mujeres víctimas de cualquiera de las manifestaciones de violencia machista.

El artículo 1 de la Ley 4/2014, de 27 de abril, del Estatuto de la víctima del delito determina que esta norma es aplicable a todas las víctimas de delitos cometidos en España o que puedan ser perseguidos en España, con independencia de su nacionalidad, de si son mayores o menores de edad o de si disfrutan o no de residencia legal. Por ello, deberán adoptarse las medidas que resulten necesarias para garantizar la tutela real y efectiva de las víctimas que se encuentran situación administrativa irregular, otorgándoles una verdadera protección. Y, en consecuencia, se deben suprimir –por ser contrarias a esta Ley– todas aquellas actuaciones que, lejos de garantizar o promover el acceso a la justicia por parte de las víctimas de delitos, les provocan una victimización secundaria.

En este sentido, el Defensor del Pueblo en 2004, 2019 y 2021 ha señalado la necesidad de que se dicten las instrucciones precisas para asegurar que las personas extranjeras en situación irregular que son presuntas víctimas de un delito puedan formular denuncia sin que se les derive, por esta causa, la incoación de un procedimiento sancionador que conlleve su expulsión del territorio nacional. Ha calificado como “cuestionable” que el funcionario policial que recibe la denuncia y deba concentrar su atención en auxiliar a la víctima del delito, pueda realizar, al menos en el mismo acto de denuncia o como consecuencia del mismo, indagaciones que permitan adverar si dicha víctima se encuentra o no en situación regular en España, dado que, el resultado de dicha actuación puede conllevar consecuencias indeseables y, por lo tanto, no compatibles con la Ley del Estatuto de la Víctima. Dicha conducta constituye también una quiebra de la equidad que, según el Tribunal Supremo, debe regir las relaciones entre la Administración y los administrados, y que constituye uno de los principios generales que informa nuestro ordenamiento jurídico. Según este órgano, con la Ley del Estatuto de la Víctima se pretende ofrecer desde los poderes públicos una respuesta lo más amplia posible, no solo jurídica sino también social a las víctimas, que sea reparadora del daño en el marco de un proceso penal, y también minimizadora de otros efectos traumáticos en lo moral que su condición puede generar; todo ello con independencia de su situación procesal. Dicho estatuto, en línea con la normativa europea en la materia y con las demandas que plantea nuestra sociedad, pretende, partiendo del reconocimiento de la dignidad de las víctimas, la defensa de sus bienes materiales y morales y, con ello, los del conjunto de la sociedad.

En definitiva, las prácticas que venimos denunciando generan desconfianza en las autoridades por parte de las personas en situación administrativa irregular y provoca que incluso rechacen acudir a dependencias judiciales para denunciar los delitos de los que son víctimas, por temor a que se incoen procedimientos sancionadores donde se puedan imponer sanciones de expulsión. Por ello, consideramos que son prácticas que vulneran sus derechos.

Además, en los casos en los que la parada que da lugar a la citación es una identificación por perfil étnico, entendemos que la identificación realizada por agentes de Policía es un acto ilegal, por estar basada en criterios discriminatorios (su perfil étnico). Como consecuencia de ello, la citación emitida por la Brigada de Extranjería posterior deviene de una actuación ilegal y por tanto nula y es nula también de pleno derecho la citada citación. Tal y como venimos denunciando, creemos que estos controles de identidad racistas tienen además una serie de consecuencias perversas, que no debemos normalizar ni tolerar, no solo para la población en situación administrativa irregular, sino para toda la sociedad en su conjunto, ya que supone la perpetuación del racismo estructural basado en la criminalización y el hostigamiento de las personas racializadas.- Para las personas de origen extranjero y/o racializadas, especialmente las que se encuentran en situación administrativa irregular o en periodo de renovación, dado que muchas de las personas que son identificadas, lo son mientras realizan una actividad cotidiana, estas prácticas inciden directamente en su día a día, generando a su vez:o Miedo a acudir a sitios que son imprescindibles para regularizar su situaciónadministrativa, realizar su labor profesional o formativa, denunciar situaciones de discriminación y/o vulneración de derechos, y en general espacios públicos para llevar a cabo una vida social digna.o Interiorización de inferioridad social y/o culpa, lo que repercute de manera directa en las relaciones sociales y laborales y en el desarrollo de una convivencia plena.o Naturalización de la situación de estrés prolongado.

Todo lo anterior, resulta especialmente peligroso para aquellas personas que se encuentran en situaciones de especial vulnerabilidad o riesgo de exclusión.

Por todo ello vamos a realizar una serie de reclamacionesa las Instituciones tanto del Gobierno de Navarra como estatales, a las que consideramos responsables de estas prácticas, como son el Departamento de Presidencia, Igualdad, Función Pública e Interior, el Departamento de Políticas Migratorias y Justicia y la Delegación de Gobierno en Navarra. Así mismo, queremos trasladar la información a la Federación Navarra de Municipios y Concejos como asociación representante de las entidades locales:• El cese de los controles de identidad basados en el perfil étnico.• El cese de este tipo de citaciones.• Petición de información al Ministerio de Interior sobre este tipo de prácticas, número de expedientes de expulsión incoados y/o ejecutados en base a este método, así como el archivo de todos ellos.• Informe sobre la legalidad de estas actuaciones, detallando la normativa en la que se basa, y petición de responsabilidades en el caso de que resulten contrarias a derecho y constituyan vulneraciones de derechos. Valoración de las consecuencias que puede tener esta práctica.• La no colaboración de los cuerpos policiales dependientes de las entidades locales y del Gobierno de Navarra en este tipo de prácticas, así como el establecimiento de medidas verificables para evitar que se lleven a cabo identificaciones y controles de identidad por perfil étnico.
